Northport Court Report: Fabbrini Charged With Petit Larceny, Violates Previous Order

Merschoff case ready for trial; other traffic cases decided during June 20 court session.

Local resident Brian Fabbrini returned to Northport court on June 20, where an arraignment on a petit larceny charge was completed.

Fabbrini was arrested on the charge this past Thursday at 12:15 a.m., and arraignment proceedings were begun soon after. A bond of $1,000 could not be posted at the time of arraignment but was later posted after Fabbrini was transported to county jail in Riverhead.

The complaining witness in the case is Fabbrini’s mother. A felony charge is expected to be added in the case. Fabbrini was previously granted a one-year adjournment in contemplation of dismissal in a case where he was charged with third-degree assault, second-degree menacing and disorderly conduct. That case was re-opened upon the filing of the new petit larceny charge.

Attorney Matthew Tuohy replaced the legal aid society as Fabbrini’s attorney in both cases. He will next appear in court on August 1.

Other Cases
Prisoner William Merschoff, who is facing two second-degree unlawful imprisonment charges, had his seeking an earlier trial date, but the court could not grant it to him as they were unable to subpoena Officer Thomas Endee, who is on vacation until the week of the 11th.

Huntley and Sandoval hearings will be required before the case can be tried. The court did reduce Merschoff’s bail from $10,000 on each docket to $5,000 on each docket per a request from Merschoff’s attorney Andrew Wolk.

Merschoff did not post the reduced bail, however, and will remain in custody until the July 11 trial date. Multiple traffic cases were reduced to 1201 A parking violations by the Suffolk County Assistant DA.

Northport resident Christine M. Lagana had her traffic device violation reduced to a parking ticket and was sentenced to a $25 fine.

Tsuneko K. Smith was also sentenced to a $25 fine after having a stop sign violation reduced to a parking ticket.

William McCarthy will also have a speeding ticket (54 miles per hour in a 35 m.p.h. zone) reduced to a parking ticket upon completion of a defensive driving course.

With preliminary jurisdiction over felonies and general trial jurisdiction over misdemeanors, traffic infractions and local ordinance violations, Village Court is in session every Monday at 7 p.m. except state holidays in Northport Village Hall.
