The Facts about this Parking Lot Accident in East Northport

Our client was driving in the parking lot of Home Depot with her mother. They had just eaten lunch at Applebee’s and were heading to Walgreens to pick up a prescription. They were traveling westbound through the parking lot, perpendicular to the rows of parked cars. The other driver was driving southbound through one of the lanes with the parked cars.

Our client was driving at a slow rate of speed because she was approaching a stop sign. Suddenly and without any warning, her vehicle was struck on the passenger side by the other vehicle, which was coming out from a lane of parked cars to her right. The impact was so sudden that she did not have time to brace herself. Our client hit her head against the steering wheel and her side door.

Police came to the scene and took witness statements. The Police Accident Report attributed the crash to other driver’s high speed and failure to yield to our client, who had the right-of-way. A witness confirmed the version of events in her statement to the police.

Our client went to the Emergency Room at St. Catherine of Siena Medical Center immediately after the collision occurred, where she was diagnosed with whiplash and a concussion. She was later diagnosed with cervical and lumbar radiculitis and bursitis in her hip. She received eight months of treatment from orthopedists, neurologists, and physical therapists.

Seeking a Settlement in this Parking Lot Accident Case in East Northport

We investigated the incident and obtained our client’s medical records. Our nurse reviewed those records and prepared a presentation on the diagnosis and test results as well as a chronology of our client’s treatment and background research on her injuries. We also researched the case law to identify the value put on similar injuries in other cases. Using this information, we prepared a case assessment for our client. Once our client was comfortable with the value of the case, we moved forward with efforts to settle the claim.

We presented a Settlement Proposal to the insurance company for the defendant. Our Settlement Proposal reviewed the facts of the incident, explained our theory of liability and presented an assessment of damages based on our medical and case law review. We also attached all of the pertinent medical records and other evidence. This package gave all the necessary information to the insurance adjuster to justify the maximum compensation and allow for a rapid settlement.

Our client bore no liability and the insurance company agreed that their insured bore 100 percent of the liability. We disagreed on the value of the injuries and spent time negotiating over that difference. In a matter of days, the insurance company raised their offer to an amount that provided good value to our client and met our client’s expectations. Our client accept the final settlement offer.
